Terms of Service

These Terms of Service (“Terms”) govern the use of services (“Services”) provided by MERTANDHOUSE, LLC (“Company,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”). By ordering, accessing, or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Services.
1. Description of Services
MERTANDHOUSE, LLC provides network services including, but not limited to:
- Assignment of one or more static IP addresses
- Connectivity via Layer 2 Tunneling Protocol (L2TP) or similar tunneling mechanisms
- Associated routing and network access services
The Services are provided “as is” and “as available.”
2. No Guarantee of Availability or Performance
MERTANDHOUSE, LLC does not guarantee that the Services, including but not limited to:
- L2TP tunnels
- Tunnel endpoints
- Routing
- Connectivity
- Latency
- Throughput
- Packet delivery
will be uninterrupted, error-free, secure, or available at any given time.
You acknowledge and agree that:
- L2TP tunnels may go down, flap, degrade, or fail entirely
- Tunnel failures may occur without notice
- Static IP reachability is dependent on tunnel availability
- Issues may arise due to upstream providers, carriers, the public Internet, Customer equipment, software, configuration, or third-party networks
MERTANDHOUSE, LLC is not responsible for any service interruption, degradation, or failure, regardless of cause.
3. No Service Level Agreement (SLA)
Unless explicitly agreed to in writing and signed by an authorized officer of MERTANDHOUSE, LLC:
- No Service Level Agreement (SLA) applies
- No uptime, latency, packet loss, or availability guarantees are made
- No credits, refunds, or compensation are provided for outages or performance issues
4. Static IP Address Use
Static IP addresses are:
- Assigned for use solely with the Company’s Services
- Not portable
- Subject to change, reassignment, or revocation at any time
MERTANDHOUSE, LLC makes no guarantees regarding:
- Continued assignment of any specific IP address
- Reputation, blacklist status, or deliverability of any IP address
5. Customer Responsibilities
You are solely responsible for:
- Proper configuration of your equipment, software, and network
- Security of your systems and credentials
- Monitoring tunnel health and connectivity
- Implementing redundancy, failover, and backups as needed
MERTANDHOUSE, LLC is not responsible for misconfiguration, security incidents, data loss, or service impact caused by Customer actions or omissions.
6. Limitation of Liability
To the maximum extent permitted by law:
- MERTANDHOUSE, LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages
- Including but not limited to loss of revenue, profits, data, business, goodwill, or use
This limitation applies regardless of:
- Cause of action (contract, tort, negligence, strict liability, or otherwise)
- Whether MERTANDHOUSE, LLC was advised of the possibility of such damages
In no event shall MERTANDHOUSE, LLC’s total liability exceed the amount paid by the Customer for the Services during the preceding thirty (30) days.
7. No Warranty
The Services are provided without warranties of any kind, whether express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Availability or reliability
MERTANDHOUSE, LLC does not warrant that the Services will meet your requirements or expectations.
8. Acceptable Use
You agree not to use the Services for:
- Illegal activities
- Abuse, attacks, or unauthorized access
- Spam, malware, or malicious traffic
MERTANDHOUSE, LLC may suspend or terminate Services immediately for violations, with or without notice.
9. Suspension and Termination
MERTANDHOUSE, LLC may suspend or terminate Services at any time, for any reason, including but not limited to:
- Network protection
- Maintenance
- Legal or regulatory requirements
- Suspected abuse or misuse
MERTANDHOUSE, LLC shall not be liable for any damages resulting from suspension or termination.
10. Indemnification
You agree to indemnify and hold harmless MERTANDHOUSE, LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Any content or traffic originating from your assigned IP addresses
11. Force Majeure
MERTANDHOUSE, LLC shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to:
- Acts of God
- Network failures
- Power outages
- Carrier or upstream provider issues
- Government actions
- Internet-wide routing events
12. Changes to Terms
MERTANDHOUSE, LLC may modify these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to conflict of law principles.
14. Entire Agreement
These Terms constitute the entire agreement between the parties regarding the Services and supersede all prior agreements or understandings.
